The fascinating thing here is that the government’s lawyer, the one supposed to argue against this guy’s return, appears to have sided against the government.

      Literally.

      That guy should come home with a fucking purple heart equivalent or something. Should be retired. Every person who failed to act should be held criminally liable to the absolute highest letter of every state law for every state they passed through and were processed (or not processed).

      Dozens of people should spend time in jail for this mistake. An example must be set.

        Yup if doctors and lawyers can be held accountable for malpractice, negligence, so should politicians and their administration. They are ruining people lives and treating it like a game.

    Hasn’t the US claimed they have no authority to do so? Last I saw, the Trump admin was claiming it’s up to El Salvador to return them.

      That’s what they’re claiming, but we all know that’s bullshit. If President Trump called up the president of El Salvador and demanded that they return the guy, it would happen. The judge knows this, which is why he ordered the return. Now we get to find out what, if anything, might happen if the government flouts the order.

      I see what you mean, but I don’t know that it’ll change any opinions. After all, he’s been clearly defined as one of the “undesirables”, so Magats will still find a way to dismiss his story.

      But, still, every bit of momentum against Trump helps, I suppose.

        Most Americans are not MAGA. If this guy gets back to a US court, and he can deliver testimony about what Trump’s DHS is doing, and what things are really like in this Salvadoran gulag, that’s the kind of primetime drama that gets people’s attention.

          Oh, all I meant is that those of us who still have working braincells are likely to already have a very dim view of this entire situation. Like preaching to the choir, you know?

          But, I’m not saying it’s not worth it. Obviously, he should be freed and treated like the human he is; and if he does go on the record, more power to him!

          Just…the whole damn thing stinks. That’s all.

    Maybe penalize ICE as well, so they have an incentive to stop. Maybe start throwing the guys who pull masks over their faces so they can kidnap people in prison for kidnapping?

    So, what happens when the judge orders something that can’t be done? Like, if this guy is dead already, or El Salvador won’t release him, what then? What is supreme, the judge or the situation?

      Obviously the judge can’t order the dead raised, but if El Salvador won’t release him then does the judge have the authority to decide whether or not Trump made a good-faith attempt to have him released? I don’t think anyone knows at this point. It’s clear to all that Trump could in fact have him released (or at least have his body returned if he has been killed) so what happens if Trump says that he tried and El Salvador said no? Will the judge accept Trump’s transparent lie, or will he risk creating a Constitutional crisis that Trump would probably win?

      I’m not optimistic. I don’t think the American system of government is capable of handling the executive branch along with a majority of the legislative branch acting in bad faith with the support of a large part of the public.
