If a fact isn’t disputed by either side in a case as contentious as this one, it’s much more likely to be true than not. You can certainly wait for the gears of “justice” to turn if you like, but I think it’s pretty clear to everyone else that LLMs are plagiarism engines.
Lol did you even read the article you linked? OpenAI isn’t disputing the fact that their LLM spit out near-verbatim NY Times articles/passages. They’re only taking issue with how many times the LLM had to be prompted to get it to divulge that copyrighted material and whether there were any TOS violations in the process.

I generally agree, but I also think it depends on the capital. There are definitely losers (in the winning/losing sense) in the business world even just two months into the second Trump regime.
How would that help in this case? If the Google battery-nerfing update is legitimate, then it’s preventing Pixel 4a phones from catching on fire or whatever.
To be clear, I’m not trying to justify Google’s handling of this situation created by their own defective hardware fuckup.

I think you’ll find that many (but not all) successful movements are driven by the potent pairing of a legitimately pissed off populace backed by capital.

Protests are for building public solidarity. You know, organizing… the only way for the masses to accomplish anything in the face of fascism. It’s not for convincing Trump of anything.
The “ethics” of following laws stem entirely from the social contract. Both sides agree to a set of rules because it’s fair or in their mutual interest to take part in society. But when one side violates that social contract (causes a constitutional crisis, ignores the rule of law, etc.) then all bets are off. If you blindly follow the rules while the other side is actively ripping them up, then you’re at best a sucker and at worst complicit.
The damage Trump and Musk can do is directly proportional to how fast they can speedrun fascism before they lose the House and maybe the Senate in the midterms. So the main lever that our elected Democratic reprentatives actually have is slowing down that effort in any way they can. That means filibustering, delaying votes, interrupting, shaking canes, getting escorted out, etc etc. Generally throwing sand in the gears of the administration. It’s not just performative, although that’s part of it. It’s to slow-roll the fascism so we have a better chance to fight it.
If you have any spare time, even half an hour here or there, go to protests. Connect with like-minded folks.

In swing States (where the election was decided), voter turnout was almost the same in 2024 as in the last presidential election. So you can stop repeating the debunked claim that voters who “stayed home” are to blame for Trump’s victory.

Don’t like that idea? Fine. Then find a way to resist that better suits you. But whining on the internet that “there’s nothing that can be done, we are fucked” doesn’t accomplish anything. Part of the goal of this administration is to create an air of inevitability around their gathering power so that people obey in advance. It makes it a whole lot easier for them to be fascists if they don’t have to fight for every scrap of fascism along the way. Don’t let them do that. Don’t obey in advance.

And I never said I was a pacifist. I said it takes multiple types of resistance to effectively counter fascism.
